1. Who May Use the Service

You must be at least 18 years old to use QuizFlow Labs.

By using the Service, you represent that:

• You have the legal authority to enter into these Terms
• You will use the Service in compliance with applicable laws
• Any information you provide is accurate and up to date

2. Accounts & Registration

To create and publish quizzes, you must register for an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring your use of the Service complies with these Terms

We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

QuizFlow Labs provides a platform to create, publish, and manage interactive quizzes, flows, and decision interfaces, including:

• Hosted quiz pages with custom URLs
• Embedded quiz widgets
• Chatbot-style and pop-over quiz experiences
• Lead capture gates (soft or required)
• Completion CTAs and redirects
• Analytics and reporting

We may modify, improve, or discontinue features at any time.

4. Plans, Billing & Payments

QuizFlow Labs offers free and paid plans.

• Paid plans are billed on a recurring basis
• Payments are processed by third-party providers (e.g., Stripe)
• Fees are non-refundable unless required by law
• Plan limits (such as submission caps) are enforced automatically
• We may change pricing or plan features with reasonable notice.

5. User Content

5.1 Creator Content

You retain ownership of content you create, including:

• Quiz questions and logic
• Branding and design settings
• Completion messages and CTAs

By using the Service, you grant QuizFlow Labs a limited, non-exclusive license to host, process, and display your content solely to provide the Service.

5.2 Respondent Data

If you enable lead capture, you are responsible for:

• Lawful collection of respondent data
• Providing appropriate notices and consents
• Complying with privacy and data protection laws

QuizFlow Labs acts as a data processor for respondent data and does not own this data.

If you process Personal Data using the Service, our Data Processing Addendum (DPA) applies.

6. Acceptable Use

You agree not to use the Service to:

• Violate laws or regulations
• Collect data without proper consent
• Distribute malware, spam, or harmful content
• Misrepresent your identity or purpose
• Interfere with or disrupt the Service

We reserve the right to investigate and take action against misuse.

7. Third-Party Services & Integrations

The Service may integrate with third-party tools (e.g., payment processors, automation platforms).

• Use of third-party services is governed by their own terms
• QuizFlow Labs is not responsible for third-party systems
• You assume responsibility for data sent to third-party integrations
• Some features may use AI providers (e.g., OpenAI) to process prompts

8. Availability & Support

We strive to keep the Service available, but we do not guarantee uninterrupted access.

The Service is provided “as is” and “as available.”

Support availability may vary by plan.

9. Intellectual Property

QuizFlow Labs and its underlying technology, designs, and trademarks are owned by Innovative Edge Consulting or its licensors.

You may not:

• Copy or reverse engineer the Service
• Use our branding without permission
• Resell or sublicense the Service without authorization

10. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• You violate these Terms
• Your use creates legal or security risk
• Required by law

Upon termination, your access to the Service will cease.

11. Disclaimer of Warranties

The Service is provided without warranties of any kind.

We disclaim all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Accuracy or reliability of results

Use the Service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

• QuizFlow Labs is not liable for indirect, incidental, or consequential damages
• Our total liability will not exceed the amount you paid to us in the past 12 months (or $0 for free users)

13. Indemnification

You agree to indemnify and hold harmless QuizFlow Labs and Innovative Edge Consulting from claims arising out of:

• Your use of the Service
• Your quizzes or collected data
• Your violation of these Terms or applicable laws

14. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Service constitutes acceptance.
